A new legislative change (Law no. 208 FROM 23 September 2020) allows the lawyer, based on the power of attorney, to request the Romanian criminal record for the holder.
The content of the power of attorney must be formulated in clear terms, from which the lawyer who was mandated, the purpose and duration of the mandate
The power of attorney is the document that has the legal meaning of power of attorney, by which the lawyer is empowered by the client, based on the validly concluded legal assistance contract, to assist/represent him before the courts of the judicial authority and other jurisdictional bodies, of the criminal prosecution bodies, of public authorities and institutions, as well as in front of other natural or legal persons and/or to carry out other activities that are the subject of this contract.
The power of attorney is valid without any other formalities.
The legal assistance contract provides, expressly, the extent of the powers that the client confers on the lawyer. Based on it, the lawyer legitimizes himself vis-à-vis third parties through the power of attorney.
